Bill removing vaccine exemptions approved by Calif. Senate panel

SACRAMENTO – Bill that would require more California children to be vaccinated before they enter school was approved Wednesday by the Senate Education Committee, a week after it stalled when members of the panel voiced concerns that it would deprive many young people of an education.

The bill next goes to the Senate Judiciary Committee for consideration of its legal ramifications.

The measure by Democratic Sens. Richard Pan of Sacramento and Ben Allen of Santa Monica would eliminate the option of parents to exempt their children from vaccinations based on a “personal belief,” meaning the only waiver available would be for medical reasons.

“While this bill won’t reach everyone, it will increase everyone’s safety against preventable diseases,” Allen told the committee Wednesday. “We think we’ve struck a fair balance here that provides more options to parents who are concerned about not vaccinating their children.”

Sen. Connie Leyva (D-Chino) voted against the bill, which was approved by a vote of 7-2. “I just still have a concern it will not go far enough to help a two-income family who can’t home-school their child or a single, working parent.”

More than a hundred opponents of the bill, many wearing red shirts, packed the committee hearing Wednesday and many said afterward they would continue their opposition as the bill heads to Judiciary Committee.

“I am shocked and disappointed,” said Tina Kimmel, an opponent who said she is a former research scientist with the Department of Public Health.

More than 13,500 California kindergarten students have waivers due to their parents’ personal beliefs, including 2,764 based on religious beliefs, state health statistics show.

The measure was introduced partly in response to a measles outbreak that began at Disneyland and eventually infected 131 California residents as well as at least 26 people in seven other states, Canada and Mexico.

However, many parents and their children testified against the measure last week, saying they didn’t believe vaccines were safe and worried that the bill would deprive young people of the right to an education. Committee members including Chairwoman Carol Liu (D-La Cañada-Flintridge) had voiced similar concerns last week.

Since then, Pan and Allen changed their bill to broaden an exemption for home-schooled children by deleting reference to students having to be members of the same household or family. That would allow multiple families to join in home-schooling their children and also receive the vaccination exemption.

Another change would add an exemption for students enrolled in an independent study program run by a public school system.

    The are not forcing parents to vaccinate their children, they are saying if you want to go to a public school where the majority of children are vaccinated, then you need your vaccinations. If not, don’t attend a Public School. That’s it, simple, straight to the point. This is no different than having to show Birth Certificate, or Proof of Residency, now finally as it should be… up to date Immunizations No WAIVERS! It’s about time.

      It actually IS forced when not everyone has the option to homeschool, we should not be FORCED to not only vaccinate against said “diseases” that have NO liability and a 3.2 BILLION DOLLAR injury compensation fund for those injured! The bill also states that any vaccines may be ADDED tbd…. By the AAP. This means vaccines that are not even out there yet. You’re a complete moron to believe “ok”ing this is OK. You are agreeing to forced vaccinations or forced quitting your job to homeschool. That’s not a choice, especially for MANY working parents. It’s also agreeing to any vaccine they decide to add that they aren’t even telling you what it is yet. Ridiculous.

      No one should be forced to choose between their religion and their children’s schooling. Many vaccines contain tissue from aborted fetuses. Many Christians don’t even realize this, but those who do, and who actually think about the ramifications, are QUITE opposed to being forced to choose between injecting aborted fetal tissue (aka “human diploid cells”) into their children or giving their children an education. Vaccines are not the be-all / end-all of health options. They are drugs, and like ANY other drug on the market – they have side effects as well.

      The law requires vaccines that are for non-communicable diseases, such as Hep B which is, according to the CDC fact sheet, most often spread through sex and drug use. Even Hep B positive children are allowed into California public schools, because no one is worried about the spread of this disease in this public setting. My children do not get this vaccine in their early years. Under this law, they would not be allowed to attend public school Kindergarten.

        Even if you are a fan of vaccination, this bill should haunt you. What other medical procedures should be required to attend school, have a job, or anything else? It is a slippery slope and people need to open their eyes.

      It isn’t just public school, btw. It is private schools, and they are struggling to even twist the language regarding home schooling. Equality in education is a right in California. And that was not written with a little asterisk saying “as long as you’re vaccinated”. Equal education can NOT be achieved by forcing kids to stay home.

      There is undeniable proof that vaccines carry a risk. Even the vaccine inserts state this is so. When a product carries a risk, there needs to be choice. Thousands of children have been injured, and it won’t be the government or the vaccine manufacturers taking care of these now disabled children. This is not the government’s call!

      If you believe that this is in no way an encroachment on individual liberties then then I think you should have your name at the top of the list when they open the Soylent Green factory they will open in the near future. This bill does not address international travelers who are not required to be vaccinated to the same standard. The risk of unvaccinated children to the vaccinated population is inexistent ergo a personal choice . If a child isn’t healthy enough to take the vaccine they (being a miniscule minority) should be homeschooled as they can catch virus from anything from birds to pigs to the products they are in.

    The vaccine industry must be a big donater to the senate committee. I once knew a guy who became completely paralyzed after receiving the flu vaccine and shortly after died. I no longer receive the flu vaccine. Plenty of hand washing and staying away from sick has kept me flu free for over 3 years.

      Exactly. There is more than ONE way to prevent the spread of disease. There is NO SUCH THING as one-size-fits-all pharmaceuticals. When there is a RISK there MUST be a choice!

      The flu vaccines will now be mandatory. Every season. Everyone knows the flu vaccination is never tested long-term. This makes me irate. The flu Vax has killed people just in the last 4 months. Look up the real stats from the vaccine court. This is not ok.

    Correction – there were not more than 100 opponents at the hearing. There were more than 1000! This was the LARGEST turnout of opposition to a bill the senate had ever seen. The government has no business deciding which drugs you take.

    State of California guarantees an education to all. The State’s DOE even says that a student cannot be discriminated against because of “perceived contagiousness”. An healthy unvaccinated person is NOT contagious! This bill is discriminatory, plain and simple. Not only that, but if the bill’s solution to fear of contagion is to increase vax rates across CA, then what is the problem, really? CA has a 93% vax rate RIGHT NOW! In addition, there is no medical emergency requiring such a draconian bill.

    What happens to a child who has an IEP and a full time aid (like my daughter) and is now forced into homeschool ? Will the district provide services at her home.

      Suzette look to Mississippi on how this works and the answer is NO, if you do not vaccinate you are on your own. You will keep on paying taxes to support a school system your child is never in. If like myself you have a vaccine damaged child who is now special needs, don’t expect to get a medical exemption either. I fought to the state level to get a vaccine exemption for my vaccine damaged son to attend school without more vaccines and was told “What difference does it make, if you want services you will vaccinate him, after all the damage has been done, what more could go wrong.” He could have died from on more vaccine. I feel for you in California, once an opened minded state, looks like you are the first to fall in what will more than likely sweep the nation. Heartbreaking.

    The amended bill does not give viable options; both “choices” are to keep your kids at home. My healthy, UN-contagious child has as much right to a public education as my neighbor’s fully vaxxed kid (who, btw, has allergies to every known entity, asthma, an auto-immune disorder, and Aspbergers). I love my kids’ school and it’s their right to attend. I cannot afford to homeschool. That is discrimination, plain and simple. Illegal and unconstitutional.

    I think CA could be turned into a victory if parents are convinced to ignore vaccine laws in mass not just in CA but across the entire country. This would require educating teens, kids, college students, and grandparents about vaccine dangers and the very real benefits of natural immunity. One of the biggest weaknesses in the anti vaccine movement is the focus on new parents–vaccination is an all inclusive issue! The other weakness is that we are not out protesting vaccine clinics on a daily and handing out information and encouraging ppl to run from the needle! I am sorry but are they really going to call the cops on middle or high school kids who refuse in school vaccination??? Are they going to bully grandparents who are protesting or teens who are trying to save their friends from being poisoned???     Absolutely it should not pass . We are not in a state of outbreak of measles which is how this whole thing got started !!! This infuriates me that we lead this country by fear tactics !!! I do not want to be forced to give my child every shot ! It is not good medicine .!!!!
