Feds raid gun parts stores despite court order

SAN DIEGO – With a search warrant in hand, federal agents from the Bureau of Alcohol, Tobacco, Firearms and Explosives confiscated computers, customer lists and the questionable polymer 80 percent lower receivers from four Ares Armor store locations throughout San Diego County over the weekend.

“There were women and children inside our retail establishment when the (ATF) agents came in with guns drawn,” said Ares Armor Executive Officer Dimitrios Karras. “They came into our manufacturing facility with their guns up like they were invading Iraq.”

The raid happened three days after Ares owner was granted a temporary restraining by a judge to stop ATF agents from searching their stores.

The ATF confirmed they were investigating the stores for federal firearm violations.

The case stems from the sale of what is called an 80% lower receiver, which gun enthusiast use to build their own rifles and guns.

Building a rifle with specific versions of the 80 percent receivers is legal.   The polymer lower receiver appears to be manufactured differently with two parts, making them a firearm and illegal sell, according to the ATF.

“We did ask the court to clarify if these things were firearms or not,” said Karras. “We did ask for protection as this gets resolved within the court system.”

Karras said they had their polymer lower receivers locked in a closet ready to turn over to the ATF since Wednesday.  He was more concerned about the federal agents taking lists of his customers’ information.

“If anybody is a criminal organization that should be investigated, I think they should look in the mirror. We gave them a black eye publicly,” Karras said. “They tried to do an underhanded deal with us. They said, ‘Hey hush, hush. Keep it secret and nobody’s going to know that we took the customer list from you. Nobody’s going to know we took this from you.’”

The investigation has some customers nervous about their right to bear arms.

“I’m on that list, and I’m waiting for the knock on the door to tell me they are here to remove my second amendment rights,” one customer told Fox 5.

        You people seem to miss a greater point here. None of these laws that are at issue are even legal themselves. We are splitting hairs over definitions. In the US, the lower receiver is the "firearm". In Europe, the upper receiver is the "firearm". It's just an issue of semantics. Having said that, every one of the 50,000+ civilian disarmament "laws" in the US are unconstitutional and thus null and void. Gun prohibition works as well as drug and alcohol prohibition which is to say not at all.

      Here's what's wrong with what's happening. We are being picked off in small pieces. When the State seizes your child, as was done in Mass, there is little recourse. When the State raids your store, there is little you can do. When we wait until the agents show up at your door, it is too late for action. There is no organized resistance.
      There is a chance in CT where there are thousands of "felons" who refused to comply with the State order to either register or dispose of their guns. I urge them to get organized.     A 'federal' employee costs 45% more than one in the similar private sector, now add in the rest of the overhead that accounts for the indirect support structure and coordination of that federal employee and you'll get a factor of X10.

    Well here you have it. The complete militarization of law enforcement. It is totally unnecessary and dangerous to "raid" a retail store with guns drawn. Except that is for intimidation purposes and movie effect.

    Two armed agents in suits could have entered the store requested the owner to have public leave and closed the store. After requesting the sought for items and getting or not getting them then execute the search warrant. That is what a civilized sociaty would do but the current "war" on citizens does not allow for common sense. An entire truckload of agents in their SWAT gear could have been waiting around the corner if the owner got out of hand.

    This group of cowards NEED to burst into a retail store like the owner is already convicted and shown to be dangerous. Would love to see a Judge examine the supervisor as to the WHY of their dangerous and cowboy like assault.

    This news story is much, much more accurate than most in the MSM, but there are still a couple of errors: 1/ Where the article says the 80% lowers are "questionable"- no, they are 100% legal. This question was resolved in the courts, repeated on multiple occasions. 2/ "According to the ATF" the 80% polymer lower receivers "make(ing) them a firearm and illegal sell"- again, NOT TRUE. This is "according to whoever is making things up out of nothing" at the ATF because there is NO law or regulation in any official ATF documentation that says this.

    It's getting close to home. Oceanside now- maybe your house next?

    Building an AR15 from an 80% lower requires a fair amount of skill and work. It is perfectly legal and does require a serial number. This is for personal use only. The ATF has for years made the rules up to suit them, often reversing course on previous "policies". They are known to stretch their interpretation of often vaguely written laws. This has always been worrisome because running afoul of the law as they interpret it can cost you ten years in prison. In this case I believe they are suggesting the polymer lowers are made up of multiple parts when, in fact, the entire lower is made of two different colors of plastic to facilitate knowing how much plastic to take off. The plastic is one solid piece. I have worked on such a lower and I can vouch that these are not two parts. For the ATF to arbitrarily decide that this lower runs afoul of the law is ridiculous. Firstly, the law says nothing about the lower having to be one piece. The law simply states the lower must be no more than 80% complete to qualify as "not a firearm." These lowers have been deemed legal to purchase without treating them as firearms with regards to the law. The same amount of work is involved to convert these two color lowers into a firearm and for this reason alone it does not run afoul of the previously agreed standard for an 80% lower. This is yet another case of the ATF making it up as they go along.

      A serial number it pointless unless a record is kept. Since you are making it yourself, and not registering it, what is the serial number for? Why not build 20 of them and number them all 1001?

    No, its gets resoved by them taking your stuff, not through the courts. The 'search' warrant was a free pass for the government to TAKE and STEAL whatever they wanted. The 'search' in search warrant used to mean search and not steal. Search warrants have become steal warrants.

    A search warrant is also a court order, and a TRO doesn't trump a search warrant issued by the court pursuant to a criminal investigation.

    You can't be a law abiding gun-owner (or partial gun manufacturer) is you don't or won't abide by the law.
